Concord Alliance Limited (“Concord”) has developed these Site Terms to govern your use of Concord’s site, located at www.meiriki-jp.com.hk (the “Site”). Concord provides the Content (defined below) available to you on the Site subject to the following conditions.

Application

These terms and conditions apply to:

* all information stored on or receivable through this or any other Meiriki-jp.com.hk server (collectively “Information”); and
* any purchase of goods or services offered, accessed or obtained through Meiriki-jp.com.hk (collectively “Meiriki”) by you (“the User”).

The Content may include logos, trademarks and service marks (collectively “Meiriki” marks) owned by Concord, its licensors, its business partners, and other third parties. No Meiriki marks may be used in any manner unless approved in advance by Concord, and/or the appropriate trademark holder.

Any comments, ideas, suggestions, questions or materials you send to Concord shall be deemed non-confidential, and you relinquish any copyright, trademark or other intellectual property right that you may have in what you have sent. By submitting comments, ideas, suggestions, questions or other materials, you further represent and warrant that the owner of such material has expressly granted to Concord a royalty-free, perpetual, worldwide, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) and to incorporate it into other works in any form, media or technology now known or hereafter developed.

Privacy

Concord is committed to protecting the privacy of information it receives from you. Concord’s privacy practices are set forth in the Site’s Privacy Policy.

The Site may contain links to sites owned or operated by parties other than Concord. Such links are provided for your convenience only. Concord does not control, and is not responsible for, the content or privacy policies on, or the security of such sites.

Revisions to the Terms

Concord reserves the right to change these Site Terms at any time in its discretion, and without notice by updating this posting. Your continued use of the Site after the posting of any amended Site Terms shall constitute your agreement to be bound by any such changes. Availability and Suitability of Services

Concord does not warrant that the Information or materials contained in Meiriki-jp.com.hk are current or accurate or that any of the products or services featured on Meiriki-jp.com.hk is available. User’s Obligations

In consideration of Meiriki’s consent to the User’s access to the Information and/or Meiriki-jp.com.hk, the User agrees:

* not to carry out or allow any infringement of our rights including without limitation intellectual property rights;
* not to use the Information or the User’s access to Meiriki-jp.com.hk for any illegal, improper, obscene or defamatory purpose;
* to take all steps to ensure the Information does not damage the User’s information or systems;
* to ensure that all information which the User provides to Meiriki-jp.com.hk is true and accurate to the best of his or her knowledge;
* to comply with Meiriki’s conducting research on access to the Information;
* to comply with all Meiriki’s disclaimers and limitations of liability set out in these terms of use; and
* to Meiriki’s personal data policies which are currently applying or may be modified from time to time.

Limitation of Liability

Concord shall not be liable to the User or any other person whether in tort, contract, statute or otherwise (including without limitation for negligence, breach of contract, defamation, or intellectual property right infringement) for:

* any direct loss;
* any consequential or indirect loss (including without limitation loss of revenue or profits); or
* the User’s liability to any other person, which is suffered or incurred by the User or any other person arising under or in any way out of the Information or the use of Meiriki-jp.com.hk.

Disclaimer of Warranties

While Concord uses reasonable efforts to include accurate and up-to-date information, we disclaim any responsibility, representation or warranty in relation to the content in the website. Concord has not reviewed all of the sites linked to the Site and is not responsible for the content of any off-site pages or links to or from any other sites. While Concord encourages third parties that link to the Site to abide by these Site Terms, Concord has no responsibility for actions of third parties. Additionally, with reference to any discussions, chats, web postings, transmissions, bulletin boards, blogs, and the like that may be on the Site, Concord assumes no responsibility or liability arising from any infringing, threatening, false, misleading, discriminating, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law, contained in any such locations on the Site.

Neither Concord nor any of its shareholders, subsidiaries, affiliates, officers, directors or employees, nor any of its agents or any other party involved in creating, producing, or delivering the Site, are liable for any direct, indirect, punitive, incidental, special, consequential or other damages arising out of or in any way connected with the use of this Site or Content whether based on contract, tort, strict liability or otherwise, even if advised of the possibility of any such damages.

Law and Severability

The terms and conditions stated here, and other notices and statements posted on this website are governed by the laws of Hong Kong, and each part of these documents shall apply to the extent permitted thereby. Any part which is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction only to the extent of the prohibition or unenforceability. That does not invalidate the remaining parts of the respective documents nor affect the validity or enforceability of that part or the remaining parts in any other jurisdiction. If the terms and conditions, notices and statements posted on this website are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.
